            Agreement to Terms: By accessing or using Flowstate BJJ, you agree to be bound by these Terms of Service. If you do not agree, do not use the app.
        

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the Flowstate BJJ mobile application ("App," "Service," "we," "us," or "our"). By creating an account, downloading, or using the App, you agree to these Terms and our Privacy Policy.

These Terms constitute a legally binding agreement between you and Flowstate BJJ. If you are using the App on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Eligibility

You must be at least 13 years of age to use Flowstate BJJ
Users aged 13-17 may require parental consent depending on jurisdiction
You must provide accurate information when creating your account
You may not create an account if you have been previously banned
You may not use the App for any illegal or unauthorized purpose

3. Account Registration and Security

3.1 Account Creation

To use certain features, you must create an account. You agree to:

Provide accurate, current, and complete information
Maintain and update your information as needed
Keep your password secure and confidential
Notify us immediately of any unauthorized access
Accept responsibility for all activities under your account

3.2 Account Termination

You may delete your account at any time through Settings. We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or for any reason at our discretion.

4. User Content and Conduct

4.1 Your Content

You retain ownership of all content you submit to the App, including:

Training logs and session data
Technique notes and journals
Comments and social posts
Profile information and photos
Voice recordings (transcribed text only)

By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, display, and process your content solely to provide and improve the Service. This license ends when you delete your content or account.

4.2 Prohibited Content and Conduct

You may not post, upload, or transmit content that:

Is illegal, harmful, threatening, abusive, harassing, or discriminatory
Infringes on intellectual property rights of others
Contains viruses, malware, or malicious code
Impersonates another person or entity
Is sexually explicit, pornographic, or inappropriate
Promotes violence, self-harm, or dangerous activities
Is spam, promotional, or commercial without authorization
Violates any applicable laws or regulations

You may not:

Use automated systems (bots, scrapers) to access the App
Attempt to hack, disrupt, or gain unauthorized access to the Service
Reverse engineer, decompile, or modify the App
Interfere with other users' enjoyment of the Service
Manipulate leaderboards or artificially inflate statistics
Resell or redistribute the App or its content

5. Subscriptions and Payments

5.1 Free and Premium Tiers

Flowstate BJJ offers both free and premium subscription tiers:

Free Tier: Limited features including basic session logging and analytics
Flowstate BJJ Pro: $9.99/month or $79.99/year with unlimited features, AI insights, and full video library

5.2 Payment and Billing

Payments are processed through Apple's In-App Purchase system
Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
You can manage or cancel your subscription in your Apple ID account settings
Refunds are subject to Apple's refund policy
Prices may change with 30 days' notice; changes apply to subsequent billing periods

5.3 Free Trials

We may offer free trial periods for Premium subscriptions. If you do not cancel before the trial ends, you will be charged the subscription fee. Trials are limited to one per user.

5.4 Cancellation

You may cancel your subscription at any time. Upon cancellation:

You retain Premium access until the end of the current billing period
Your account reverts to the Free tier (your data is retained)
No refunds for partial periods

6. Intellectual Property

6.1 Our Property

Flowstate BJJ and all its content, features, and functionality (including but not limited to software, code, design, graphics, logos, and video tutorials) are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws.

6.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial use in accordance with these Terms. This license does not permit:

Modifying or copying the App
Creating derivative works
Reverse engineering or extracting source code
Commercial use without authorization

6.3 Video Content

Video tutorials in the App are licensed from third-party instructors or embedded from platforms like YouTube. You may not download, redistribute, or use these videos outside the App without permission from the content owners.

7. Third-Party Services

Flowstate BJJ integrates with third-party services including:

Apple Health (health data sync)
Apple Watch (quick logging)
YouTube (video embeds)
RevenueCat (subscription management)

Your use of these services is subject to their respective terms of service and privacy policies. We are not responsible for third-party services.

8. Disclaimers and Limitations

8.1 Medical and Training Disclaimer

IMPORTANT: Flowstate BJJ is a tracking and analytics tool, NOT medical or professional training advice. The App provides information for educational purposes only and should not replace professional instruction, medical advice, or common sense.

Brazilian Jiu-Jitsu involves physical contact and risk of injury. You assume all risks associated with training and practice. Always:

Train under qualified instructors
Consult a physician before starting any training program
Follow safety protocols and tap early
Listen to your body and rest when needed
Use proper technique and supervision

We are not responsible for injuries sustained during training, whether or not you use our App.

8.2 AI Insights Disclaimer

AI-powered insights and recommendations are based on algorithms and statistical analysis of your data. They are suggestions, not guarantees. Results may vary. Use your judgment and consult with qualified coaches for personalized training advice.

8.3 "As Is" Service

Flowstate BJJ is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

Warranties of merchantability or fitness for a particular purpose
Accuracy, reliability, or completeness of content
Uninterrupted or error-free service
Security or absence of viruses

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

We are not liable for any indirect, incidental, special, consequential, or punitive damages
We are not liable for any loss of data, profits, revenue, or business opportunities
Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim
We are not responsible for third-party content, services, or user conduct

Some jurisdictions do not allow limitation of liability for certain damages, so these limitations may not apply to you.

10. Indemnification

You agree to indemnify, defend, and hold harmless Flowstate BJJ, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

Your use of the App
Your violation of these Terms
Your violation of any rights of another party
Your content or conduct

11. Data and Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it carefully to understand how we collect, use, and protect your data.

12. Changes to the Service

We reserve the right to:

Modify, suspend, or discontinue any part of the Service at any time
Change features, functionality, or content
Impose limits on certain features or services

We will make reasonable efforts to notify users of significant changes.

13. Changes to Terms

We may update these Terms from time to time. When we do:

We will update the "Last Updated" date
For material changes, we will notify you via email or in-app notification
Continued use after changes constitutes acceptance of the new Terms

14. Governing Law and Disputes

14.1 Governing Law

These Terms are governed by the laws of Cyprus, without regard to conflict of law provisions.

14.2 Dispute Resolution

If you have a dispute with us:

Mediation: If informal resolution fails, we agree to attempt mediation
Arbitration: If mediation fails, disputes will be resolved through binding arbitration (except small claims court)

14.3 Class Action Waiver

You agree to resolve disputes on an individual basis and waive the right to participate in class actions or collective proceedings.

15. Apple-Specific Terms

For iOS users:

These Terms are between you and Flowstate BJJ, not Apple
Apple has no responsibility for the App or its content
Apple has no obligation to provide support
Apple is a third-party beneficiary of these Terms and may enforce them
You must comply with Apple's App Store Terms of Service

16. General Provisions

16.1 Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and Flowstate BJJ regarding the Service.

16.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

16.3 Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

16.4 Assignment

You may not assign or transfer these Terms without our consent. We may assign these Terms without restriction.

16.5 Force Majeure

We are not liable for delays or failures caused by circumstances beyond our reasonable control (e.g., natural disasters, pandemics, government actions).
